California lawmakers to allow condoms in prisons
August 24, 2006

SAN FRANCISCO (Reuters) - California lawmakers passed a bill on Thursday to permit condom distribution in the state's prisons, where the HIV infection rate is eight times higher than on the streets of Los Angeles.

The bill now goes to Gov. Arnold Schwarzenegger, who has not yet taken a position on it, according to his office.

California has the largest corrections system in the United States, with 162,000 mostly male inmates. Supporters say condoms are needed to stop the spread of HIV and AIDS among inmates and protect sexual partners of released prisoners.

The bill's author, Assemblyman Paul Koretz, said the HIV rate in state prisons is estimated to be eight times greater than among the general population of Los Angeles County.

any type of homosexual activity in prisons should be dealt with in some way, and a death penalty should be automatically given for someone who rapes.

What "other way" do you propose? There are only so many gaurds Streets. And since preventing all homosexual activity in prison is unfeasable I feel the condoms are a good idea. After all many of these men are in the closet and end up bringing diseases home to loved ones upon release.

Public health agencies and nonprofits would begin distributing condoms to California prison inmates under a bill sent this week to Gov. Arnold Schwarzenegger, a measure modeled after similar programs in other states and cities.


Democrats who support the effort said making condoms available will help control the spread of HIV and other sexually transmitted diseases.


"Everyone knows that sex happens in prison, and short of solitary confinement for all ... inmates, the state is unable to prevent it," Assemblyman Paul Koretz, D-West Hollywood, said in a statement.


Various studies put the incidence of homosexual activity inside prisons at between 30 percent and 60 percent of male inmates, while the rate of HIV infection is at least five times that of the outside population, Koretz said.


Critics say the spread of sexual diseases could be prevented by enforcing state law, which bans sex between inmates. Republicans who oppose the bill said distributing condoms in prisons will only encourage sex between male inmates.


Sen. Charles Poochigian, R-Fresno, said the bill "sends entirely the wrong message."


"Prisons are to punish criminals. They shouldn't be sanctioning activities that are illicit," said Poochigian, who is running for state attorney general.


Instead, Poochigian said state prisons should clamp down on prison gang activity, which encourages sexual acts between inmates.


The bill's opponents also said inmates could use condoms as weapons or as devices to hide illegal drugs.


California prisons have an average of 1,240 inmates infected with HIV/AIDS, costing the department more than $18 million a year in health care, according 2003-2004 data provided by the state Department of Corrections.


Condoms are available in prisons in Vermont and Mississippi, as well as in jails in New York City, Los Angeles, San Francisco, Philadelphia and the District of Columbia, according to research by Koretz's office.


Australia, Canada, most of the European Union and parts of Latin America also allow condoms to be distributed in prison, according to the Koretz research, which was compiled from AIDS foundations and academic studies.


The Senate approved the bill Thursday 22-16 along party lines.


A Schwarzenegger spokesman said the governor had not taken a position on the bill.

Another transparent attempt to promote homosexuality. By providing condoms, they're saying, "It's okay to be a fag, just be safe about it". They know DAMN well, that once people start that type of behavior and become desensitized to the disgusing act itself, it won't be long before the toss the condoms to the side and go for it raw. VOILA!!! More HIV cases in prison, more disease brought back to the black community, and more DEAD black people!!!

The sad thing is, we fall for this type of shit every time. It's like somebody wants to kill you, but they're scared to go to jail. So they trick your dumb ass into putting the gun to your head and pulling the trigger your damn self!!!

Nastiness. They don't need condoms, Inmates who did not participate in violent activities should be allowed one hour out of the week to go get laid. Cuz that shit is just harsh, depriving a nigga like that... I'd end up killing myself. The Prison system is one of the reasons America has such a large gay population...

That's real talk!!! I saw a documentary about some prison that allows conjugal visits based on behavior. That shit had people in line, 'cause ain't nobody wanna lose that visit. The got to spend like 48 hours once every 2 or 3 months. Niggas was actin' like the knew.

yeah well... too bad so many mental illnesses are treated as criminal behavior

alcoholism and addiction are treated with prison terms in a society that has given up on any sort of spiritual solution.
because that prop 36 joke is just a free pass without much affect on changing lives

lots of people earn their way into prison without any effort while others fight their way in tooth and nail as if it were a freakin pleasure palace or something, I dont know.
