He pleaded guilty to his part in the gang-related murder of a co-worker and gave police enough information to track down his alleged accomplices, the murder weapon and the car used in the getaway.
Jose Monroy Vega even testified at the trials of his co-defendants — the only one of the three who cooperated with authorities. But on Thursday, the 22-year-old Minneapolis man became the only one who will go to prison for the murder of Luis Alberto Anaya.
Vega, appearing before Ramsey County District Judge George Stephenson, was sentenced to 12 years in prison on charges of seconddegree unintentional murder and committing a crime to benefit a gang.
Authorities said three members of the Surenos 13s sat waiting for 22-year-old Anaya to show up at the Frogtown produce distribution center where he worked. Just before dawn on Oct. 6, he was shot as he carried his lunch in a plastic container on his way into work. He died before reaching a hospital.
Vega testified at the trials of Ramiro Montoya Pineda and Juan Carlos Ortiz-Mendoza, both 19, also of Minneapolis. He told jurors Pineda gave a gun to Ortiz-Mendoza, who then allegedly shot Anaya. But jurors didn't believe his stories and both Pineda and Ortiz-Mendoza were acquitted.
Nevertheless, Assistant Ramsey County Attorney David Miller said prosecutors never had reason to doubt Vega's truthfulness. During his sentencing, Vega, through a Spanish interpreter, apologized for his actions — he contends he only drove the getaway car — and said he was sorry that Anaya's survivors had to go through this experience.
One of his defense attorneys tried to persuade Stephenson that 10½ years in prison was sufficient for his crimes.
"This is a tragic case," said Ramsey County assistant public defender Carolina Lamas. "It's tragic that so many young people are in gangs, and it's tragic that so many of their offenses are related to those gangs."
She also urged the judge to remember Vega's actions after Anaya was killed.
"He did a ride-along — not just with police inSt. Paul, but also (with) police in Minneapolis — to locate other offenders," Lamas said.
But in the end it was the words of Anaya's sister that seemed to stick with Stephenson.
"Please remember that (authorities) don't know who the shooter was," said Erika Anaya. "He could possibly be the shooter. Just consider that."
Vega, who pleaded guilty in January, admitted that he pinpointed Anaya as a target of gang retaliation in a long-running feud between the Surenos 13s and the Latin Kings.
He told investigators that his gang wanted to get back at the Latin Kings, believing they were responsible for breaking windows on some cars in South Minneapolis. Vega told fellow gang members he believed one rival worked at a business where he worked himself — not knowing whether Anaya was an active Latin King or even involved in the broken car windows.
Police were led to Vega after he didn't show up for work the day of the shooting. He was arrested the same day. In exchange for Vega's plea, prosecutors agreed to recommend he receive a sentence at the lower end of the sentencing guidelines.
The Surenos 13s (Surenos means "southerners" in Spanish) and the Latin Kings have long been known to authorities as rival gangs.

Five men were convicted yesterday on conspiracy and racketeering charges for being members of a Petersburg gang and dealing crack cocaine.
After about four hours of deliberation in U.S. District Court, a jury convicted Petersburg residents Christopher M. Brown, Antoine D. Allen, Kevin Batts, Kevin Langston and Mario L. Allen on charges of conspiracy to possess with intent to distribute crack cocaine, and conspiracy to violate the Racketeer Influenced and Corrupt Organizations Act, or RICO, which stiffens sentencing for those convicted of conspiring to commit a crime.
The five defendants could receive up to life in prison when they are sentenced Nov. 17. Defense attorneys said they will most likely appeal the verdicts on that date.
Family members and friends sobbed in the courtroom as the verdicts were read.
According to prosecutors at closing arguments Monday, the five men, in addition to 31 other men who were also indicted on conspiracy and racketeering charges, worked as a gang and sold drugs to further or enhance their criminal enterprise.
The 31 men had already pleaded guilty, and a number of them testified against the five defendants in the trial that started last week.
A joint investigation between federal authorities and Petersburg police resulted in charges against the 36 men, who prosecutors said were part of an enterprise known as the Third Ward Gang that operated drug deals in the Third Ward of Petersburg from 1998 to 2003.
Assistant U.S. Attorney Roderick C. Young said the alleged gang participated in acts of violence that plagued the Petersburg community, including the 2001 murder of Robert Brabson, who was shot in the chest as he was standing outside the lobby of the Royal Inn Motel in Petersburg. Young said Brabson was not the intended target but was caught in the crossfire of gang activity.
Defense attorneys argued that the men did not work as a gang but sold drugs independently.
"There were no documents found to prove that a gang existed," said defense lawyer Carolyn V. Grady, representing Brown. "Each man sold for himself," she said, referring to a surveillance tape used as evidence to show some of the defendants entering cars to sell drugs.
Grady said the video showed the men racing to cars and shoving each other out of the way to be the first to sell. "If they were in a gang, why would they be trying to push each other out of the way?" she asked the jury. "They didn't share to enhance any enterprise. They were in it for themselves."
Defense attorneys also questioned the credibility of some witnesses, saying the testimony of other alleged members of the Third Ward Gang and convicted felons against the defendants was false and made in exchange for a reduction in prison sentences.

Authorities say Jamaal Johnson is a member of the Rolling Sixties Crips -- a gang in the news recently after federal authorities unsealed a sweeping 81-count indictment against nearly two dozen members.
Authorities say the gang terrorized neighborhoods in Las Vegas and North Las Vegas, running a major drug operation.
A jury has convicted Johnson of murder and robbery in the deaths of 23-year-old Adrian Williams and 34-year-old Patrick Hawkins.
Johnson faces a minimum of 40 years in prison but could receive life in prison when he is sentenced October 2nd.
(Aug. 15) -- Residents living in gang-infested neighborhoods are hoping to get a little relief from the violence and fear that surrounds them.
In less than 24 hours, five gang members with the Rolling Sixties Crips have been put behind bars and more arrests are expected. This after an 80-count indictment was filed in U.S. District Court.
The crimes date as far back as the early 1990's. At a late morning news conference on Thursday, the FBI and U.S. Attorney's office declared their intense effort to do away with gang violence that has taken over some neighborhoods for at least a decade.
Four arrests made Wednesday, one arrest made Thursday. But seven more men with the Rolling Sixties Crips are still out there and law enforcement from Metro police to the FBI are looking for them.
Wanted are: Henry Carr, who goes by the name of Hanco; Clarance Breland, also known as Lanod; Jordan Crane, who is called "TD" or "TP"; Todd Davis; Demarlo Keith Kelly a/k/a Key Calvin Moten or Mo-D and Floyd Strickland who goes by Lil'
"For a lot of years these gangs have run amuck in our cities and it's time we took positive action against them," said Deputy Chief Mark Paresi, North Las Vegas Police.
The gang members are charged with crimes that range from running drug houses to murder. Josephine Rossum's lives right in the middle of gang territory. Only a few feet away from where the front of homes are spray painted in Crip tags.
"It's just like it keeps going and when is it going to end?" Rossum asks. Her home is decorated with angels, but riddled with bullet marks both inside and out.
"They come through here shooting. It's just rounds and rounds and nobody got hit but it went in the structure of the home," said Rossum. Having lived here for 30 years, Rossum has seen an strong effort by police to crack down on gangs but to no avail.
Hearing gunshots in the night is normal for her and her daughter. "I ask the Lord to cover me in his blood and cover the home. What will be will be," said Rossum.
This indictment is a continuance from a two-year-long investigation. Originally there were 38 gang members, 11 so far have already been convicted in federal court and sentenced, 27 are subject to prosecution.

KNOXVILLE (AP) — A federal jury determined a Knoxville street gang was a drug-trafficking organization working to distribute crack cocaine in the city.
The verdict, coming Monday after about six hours of deliberations stretching from late last week, capped a three-week trial in U.S. District Court.
Walter ‘‘Heavy’’ Williams, 31, the leader of the Imperial Insane Vice Lords, faces life in prison. Two other gang members, Allen ‘‘Capone’’ Young, 34, and Michael ‘‘New York’’ Smith, 21, also were convicted. Young could receive life in prison while Smith faces up to 40 years.
Seventeen gang members had pleaded guilty, leaving the case against Williams, Young and Smith as a test of a federal task force’s use of conspiracy laws to dismantle an entire gang.
‘‘It’s tough to infiltrate a gang,’’ Assistant U.S. Attorney David Jennings told The Knoxville News Sentinel. ‘‘We used every tool available to investigate this case. Federal drug conspiracy laws are tough. We went into this investigation thinking that proving a drug conspiracy was the only effective way to take the Vice Lords off the streets for a very long period of time.’’
Attorneys for the convicted gang members said they would appeal.
The case began in July 2002 with an indictment that named 20 gang members as co-conspirators and said the gang’s only purpose was to run the crack market in Knoxville’s inner city. A task force that included the FBI, the U.S. Drug Enforcement Administration and the Knoxville Police Department spent more than a year compiling evidence in the case.
Senior U.S. District Court Judge James Jarvis scheduled an April 6 sentencing date for Williams, Young and Smith.

BLOODS GANG MEMBER GETS FIFTY YEARS FOR MURDER
A 20-year-old Paterson man and Bloods gang member was sentenced Thursday to 50 years in prison for his role in the execution-like killing of a fellow gang member in a drug-money dispute.
Prosecutors said that Ronald McGraw, Rashawn Cooks, and George Jacobs went to kill Michael Carter on March 31, 2002, at the Island Bar in Paterson, because Carter wasn't sharing his drug proceeds with Bloods establishment. Also, Carter was suspected of befriending a member of the rival Crips street gang.
A jury in state Superior Court in Paterson convicted McGraw on Jan. 26 of murder, conspiracy to commit murder, and weapons possession.

Yeah im from Minneapolis I read about that 1st post of yours. Thats a trip about the Sureno S.A. who sniched on his two homies and then it turned around that his two homies got acquitted and he'll be stuck doing a 12 piece in prison. lol thats cold. But it goes to show keep yo damn mouth shut. He thought he was gonna get a sweet deal by rattin and hoped his homies would get banked with life. Now they laughin at his ass while their free and he's in the pen gettin whooped on by his own homies and the Kings. Because unlike Cali the mexican gangs dont get along in prison. Shoulda kept his damn mouth shut.

BALTIMORE — A jury spared two members of a murderous drug gang from federal death sentences yesterday, instead deciding that the men should spend the rest of their lives in prison.
The jury deliberated for about five hours in the case against Keon Moses, 21, and Michael Taylor, 20, before bringing their unanimous decision to U.S. District Judge Catherine Blake.
The jury convicted Moses and Taylor earlier this month for conspiring to sell crack cocaine from 1999 to 2003.
In addition, Moses was convicted of four counts of using a firearm in relation to a drug conspiracy in the deaths of Ronald Harris, 23; Gregory Spain, 30, and Robert McManus. Moses also was convicted of using a firearm in a drug conspiracy that resulted in the wounding of Charles Brockington, who survived to testify against him.
Taylor also was convicted of using a firearm in a drug conspiracy in the death of Mr. McManus and witness tampering.
The trial, which lasted nearly four months, was Baltimore's first federal death-penalty case in more than five years.
Taylor's attorney, Robert Waldman, said he thought that, in opting for life sentences without parole, the jury considered the defendents' ages.
"I think that this jury was also very impressed with the youthfulness of these fellows, and that this jury required much more before imposing such a final solution," Mr. Waldman said.
Authorities said the men were linked to eight killings and other shootings to assist their illegal business. Prosecutors argued Moses and Taylor undermined the criminal justice system by killing Mr. McManus in February 2002 to prevent him from testifying against Moses.
Defense attorneys frequently referred to the "toxic atmosphere" of the West Baltimore section where the men grew up — one of the city's poorest areas where drug dealing and violence are rampant. Taylor and Moses were members of a gang called the Lexington Terrace Boys.
"In their world, it was kill or be killed," Moses' attorney Carroll McCabe told jurors Tuesday in her closing argument.
Witnesses testified that the gang was responsible for a variety of crimes to protect its members and drug trade, including murders, attempted murders, witness tampering, arson and armed robbery.
Defendant Aaron Foster, who didn't face the death penalty in this case, was convicted on a conspiracy charge, witness tampering, using a firearm in a drug conspiracy and carjacking. He faces a maximum penalty of life in prison in this case, but could face the death penalty in a case scheduled for trial next year.

ALEXANDRIA, Va. – Four alleged members of a street gang with thousands of members in northern Virginia were charged Thursday with killing a pregnant teenager who had joined the gang and later became a federal informant.
The indictment says the four conspired to kill Brenda Paz, 17, after she left the Witness Protection Program against the advice of the FBI. Paz's body was found in Shenandoah County in July 2003; she died of multiple stab wounds.
The former member of the MS-13 member gang had been helping federal agents in a murder case against her one-time boyfriend, Denis Rivera, 20, of Alexandria. Prosecutors were able to introduce Paz's testimony at trial through her court-appointed guardian, and Rivera was convicted and sentenced to life in prison for the 2001 murder of Joaquim Diaz.
Rivera and three other men were charged with Paz's death: Oscar Antonio Grande, 21, of Fairfax; Ismael Juarez Cisneros, 25, of Vienna; and Oscar Alexander Garcia-Orellana, 31, of Fairfax.
U.S. Attorney Paul McNulty said Thursday that Attorney General John Ashcroft must decide whether to authorize prosecutors to seek the death penalty.
While Rivera was in jail awaiting trial for the Diaz murder, he put out word to fellow gang members that he wanted Paz killed, prosecutors allege. Five of the 19 gang members indicted by a grand jury were arrested Thursday, police said. The other 14 were still being sought.
Charging that the St. James Gang acted with "the intent to intimidate or coerce a civilian population," Bronx District Attorney Robert Johnson said the grand jury was justified in adding the terrorism stipulation to several counts including conspiracy, murder and gang assault.
Johnson said it was the first time he was aware of that the terrorism statute had been used in such a way. The law, passed by the state Legislature six days after the Sept. 11 attack, allows for more severe sentences.
Edgar Morales, 22, who was arrested Thursday, faces the most serious charge, second-degree murder as a terrorist act, for the shooting death of a 10-year-old girl in August 2002 at a baptism party.
If convicted on that charge, Morales, who also faces several other charges, would face a mandatory life sentence without parole. The charge without the terrorism stipulation would carry a sentence of 25 years to life.
The four other men arrested Thursday were charged with conspiracy and could face as much as 25 years in prison if convicted.

LAS VEGAS - - A Rolling 60s Crips street gang member, who was indicted by a Federal Grand Jury last August along with 20 others, pleaded guilty today before U.S. District Judge James C. Mahan to racketeering and firearm charges, announced Daniel G. Bogden, United States Attorney for the District of Nevada. Additionally, the plea agreement of a co-defendant who pleaded guilty in November 2003 was unsealed today. Both were originally charged in an 80-count Indictment returned on August 12, 2003; however, an 88-count Superseding Indictment was filed on March 23, 2004, which added additional charges and another defendant.
ANTONIO GIVENS, aka Riddler, age 34, of Las Vegas, entered guilty pleas to Counts 2 and 77 of the Superseding Indictment, charging him with Conspiracy to Engage in a Racketeer Influenced Corrupt Organization (RICO) and Use of a Firearm During a Crime of Violence. The parties agreed to a sentence which is binding on the Court whereas GIVENS will serve between 235 and 272 months in prison.
In entering his guilty pleas today, GIVENS admitted that he was associated with the Rolling 60s Crips gang in Las Vegas. GIVENS admitted that the gang primarily made its money selling crack cocaine, and controlled the sale of drugs in an area of Las Vegas known as West Las Vegas by using guns and violence. This included threatening witnesses with arson, physical abuse and murder, and committing drive-by shootings of witnesses' cars and apartments to deter them from providing reports to law enforcement.
GIVENS admitted they "jump in" new gang members, and teach them how to sell drugs and protect other gang members. GIVENS admitted the gang members operated drug houses or "spots," in apartments or hotel rooms for the purpose of selling drugs. GIVENS admitted that he committed the following robberies in Las Vegas by using force, violence and fear of injury, and in the last case, by also brandishing a firearm:
• May 3, 1995 robbery of the Albertson's grocery store at 3864 West Sahara;
• May 24, 1995 robbery of the Ambassdor Hotel at 916 Fremont Street; and
• July 7, 2002 robbery of the Gold Spike Casino
ANTONIO GIVENS, aka Riddler, is scheduled for sentencing on Monday, August 9, 2004, at 1:30 p.m., before U.S. District Judge Mahan. He is in federal custody pending sentencing.
Also today, the Government unsealed the plea agreement of co-defendant FREDDIE PRENTISS, aka Romeo, age 34 of Las Vegas. PRENTISS pleaded guilty on November 18, 2003, to Count 1 of the Indictment charging Participation in a Racketeer Influenced Corrupt Organization.
PRENTISS admitted that he was a member of the Rolling 60s Crips gang in Las Vegas, and is considered an O.G. (Original Gangster) or leader within the gang. PRENTISS admitted to the distribution of a total of 104.1 grams of crack cocaine on four occasions in Rolling 60s Crips "turf" or with other Rolling 60s gang members. PRENTISS is facing up to life in prison, and is scheduled to be sentenced on August 9, 2004, before Judge Hicks. He is also in custody pending sentencing.
The other 20 co-defendants are currently pending trial and set for a status hearing on June 22, 2004, at 1:30 p.m.
The investigation and prosecution of the members of the Rolling 60s street gang and their involvement in violent crime and drug trafficking in Clark County, Nevada, is the largest of its kind in the area, and has required the resources, coordination and cooperation of numerous federal, state and local agencies.
The charges and arrests marked the culmination of an almost two-year long investigation by federal and local law enforcement task forces into an onslaught of gang-related homicides, illegal gun use, and drug trafficking in North Las Vegas and Las Vegas. Since the investigation began, 44 defendants have been indicted in United States District Court in Las Vegas, and 17 defendants have been convicted thus far. Numerous others have been charged and convicted in the 8th Judicial District Court in Clark County and prosecuted by the Clark County District Attorney's Office.
The federal case is being investigated by the FBI's Violent Crime Squad, the Bureau of Alcohol, Tobacco, Firearms and Explosives, the Las Vegas Metropolitan Police Department, the Henderson Police Department, the North Las Vegas Police Department, and is being prosecuted by Assistant U.S. Attorneys Kathleen Bliss and Brian Quarles.

After several days of stalled deliberations, Tuesday brought a dizzying array of decisions for cop killer Maurice "Ece" Day, who was convicted of first-degree murder. And then during a court recess he staged an attempted escape as he slithered through a small opening in a jail cell that is used to pass in food. He was captured within minutes.
The trial ended about 6:30 p.m. after the jury became deadlocked as to a sentence of life in prison or death for Day in the Oct. 16, 2001 shooting death of Chester Police Cpl. Michael Beverly.
Because the jury couldn?t reach a unanimous decision, under the law Judge Charles C. Keeler imposed a mandatory sentence of life in jail for Day, 21, of Chester.
Beverly?s family gathered outside the courthouse later and his twin sister, Michelle, spoke on behalf of his wife Claudia and other family members. She thanked Assistant District Attorney James Mattera and other authorities for seeing them through the difficult proceedings.
"We have accepted the jury?s verdict and the sentence that the judge has rendered of life in jail without parole. We are satisfied," she said, explaining that the family was not looking for a death sentence. "Our family does not choose to put anyone to death. That?s why we are satisfied with the verdict."
Beverly was shot multiple times while on duty in the 1000 block of Ward Street, Chester. His body was discovered near his unmarked police car. His car keys were clenched in his hand and his gun was secured in his holster.
"It?s closure on one level. But we no longer have Mike. Mike is no longer with us and will never be with us again," said the victim?s sister.
Earlier in the day Claudia Beverly, the police officer?s widow, fought back tears as she testified during the penalty phase that she was married for 16 years to the victim. She also brought with her a photograph of their five children ranging in age from 16 to 5 shown surrounding a picture of their father.
"It?s been very hard for me and my children without him," she told the jury.
Defense Attorney G. Guy Smith, who asked the jury to spare his client?s life, also called Day?s sister and his father to the stand. Day?s sister, Ericka Tillery, described her brother as "my heart. He?s the other half of me." And she said that Day was "very protective" of me, my sister and my mother.
Smith asked the jury during the penalty portion to consider Day?s age of 18 at the time of the crime and that he has no prior criminal record, except for a juvenile weapon?s offense.
Mattera sought death for Day stating the defendant laid in wait and ambushed the police officer. He said Day was motivated to kill because he was "teased, taunted and ridiculed" about Beverly?s relationship with his mother by members of the notorious Boyle Street Boys. Several gang members testified during the trial for the prosecution and linked Day to the killing.
The defendant, who was captured by sheriff?s deputies in a courthouse corridor during his brief run for freedom, remained in shackles when he was brought back into court for the death-penalty hearing.
Prior to sentencing, Day sat leaning back in his chair staring at the courtroom ceiling looking almost as if he had turned off the proceedings. However, when asked by Keeler if he had anything to say the defendant complained about the evidence stating it "ain?t right."
Smith said that he was "greatly relieved" that the jury did not bring in a death-penalty verdict. "This has been a grueling experience for everyone," he said. "We?re all exhausted."
Chester Police Detective Todd Nuttall, who led the investigation, hailed the first-degree murder conviction. "It was the right verdict. There were a lot of sighs of relief," he said.
District Attorney G. Michael Green praised Mattera who "has lived with the case since the beginning." He called it a "great victory for uniformed police officers," And he termed Beverly?s "execution-style killing reprehensible."
Chester Police Officer John Kaisner, the major liaison officer for the mayor, said he was a friend of Beverly and has also been aiding the family during their ordeal. He cried openly when the verdict was announced. "I felt Michael (Beverly) knew then that the right thing happened."
The jury that convicted Day had actually reached a decision Friday. However, since one of its members was hospitalized several days for a kidney stone problem, the verdict was not revealed until yesterday morning.
With shocking speed after the ill juror returned, the panel came back and rendered its verdict. Prior to the jury?s decision, Keeler cautioned those in the courtroom not to react.
He said he did not want a repeat of what he had to undergo during a verdict last October. At that time, the courtroom erupted when Keeler, who presided over the non-jury trial, found co-defendant Joseph James Holmes, 30, of Chester, not guilty of conspiring with Day in Beverly?s killing.
The testimony at both trials was markedly different. And there was no testimony linking Holmes to the violent Boyle Street Boys drug gang as occurred during Day?s trial.
Several members, including Brian Rogers, 25, who pleaded guilty in federal court in one killing and conspiracy in another, testified that Day admitted he killed Beverly. "He shot him in the face a couple of times," Rogers quoted Day as saying.
Another crucial witness came from Day?s cousin, who is not a gang member. The cousin while on the stand wiped away tears and reluctantly tied Day to Beverly?s shooting death.
"I asked him if he done it. He (Day) told me he killed the cop -- he shot him. He said he done it. I?m not sure of his words," he testified.

The trial ended about 6:30 p.m. after the jury became deadlocked as to a sentence of life in prison or death for Day in the Oct. 16, 2001 shooting death of Chester Police Cpl. Michael Beverly.
Because the jury couldn?t reach a unanimous decision, under the law Judge Charles C. Keeler imposed a mandatory sentence of life in jail for Day, 21, of Chester.
Beverly?s family gathered outside the courthouse later and his twin sister, Michelle, spoke on behalf of his wife Claudia and other family members. She thanked Assistant District Attorney James Mattera and other authorities for seeing them through the difficult proceedings.
"We have accepted the jury?s verdict and the sentence that the judge has rendered of life in jail without parole. We are satisfied," she said, explaining that the family was not looking for a death sentence. "Our family does not choose to put anyone to death. That?s why we are satisfied with the verdict."
Beverly was shot multiple times while on duty in the 1000 block of Ward Street, Chester. His body was discovered near his unmarked police car. His car keys were clenched in his hand and his gun was secured in his holster.
"It?s closure on one level. But we no longer have Mike. Mike is no longer with us and will never be with us again," said the victim?s sister.
Earlier in the day Claudia Beverly, the police officer?s widow, fought back tears as she testified during the penalty phase that she was married for 16 years to the victim. She also brought with her a photograph of their five children ranging in age from 16 to 5 shown surrounding a picture of their father.
"It?s been very hard for me and my children without him," she told the jury.
Defense Attorney G. Guy Smith, who asked the jury to spare his client?s life, also called Day?s sister and his father to the stand. Day?s sister, Ericka Tillery, described her brother as "my heart. He?s the other half of me." And she said that Day was "very protective" of me, my sister and my mother.
Smith asked the jury during the penalty portion to consider Day?s age of 18 at the time of the crime and that he has no prior criminal record, except for a juvenile weapon?s offense.
Mattera sought death for Day stating the defendant laid in wait and ambushed the police officer. He said Day was motivated to kill because he was "teased, taunted and ridiculed" about Beverly?s relationship with his mother by members of the notorious Boyle Street Boys. Several gang members testified during the trial for the prosecution and linked Day to the killing.
The defendant, who was captured by sheriff?s deputies in a courthouse corridor during his brief run for freedom, remained in shackles when he was brought back into court for the death-penalty hearing.
Prior to sentencing, Day sat leaning back in his chair staring at the courtroom ceiling looking almost as if he had turned off the proceedings. However, when asked by Keeler if he had anything to say the defendant complained about the evidence stating it "ain?t right."
Smith said that he was "greatly relieved" that the jury did not bring in a death-penalty verdict. "This has been a grueling experience for everyone," he said. "We?re all exhausted."
Chester Police Detective Todd Nuttall, who led the investigation, hailed the first-degree murder conviction. "It was the right verdict. There were a lot of sighs of relief," he said.
District Attorney G. Michael Green praised Mattera who "has lived with the case since the beginning." He called it a "great victory for uniformed police officers," And he termed Beverly?s "execution-style killing reprehensible."
Chester Police Officer John Kaisner, the major liaison officer for the mayor, said he was a friend of Beverly and has also been aiding the family during their ordeal. He cried openly when the verdict was announced. "I felt Michael (Beverly) knew then that the right thing happened."
The jury that convicted Day had actually reached a decision Friday. However, since one of its members was hospitalized several days for a kidney stone problem, the verdict was not revealed until yesterday morning.
With shocking speed after the ill juror returned, the panel came back and rendered its verdict. Prior to the jury?s decision, Keeler cautioned those in the courtroom not to react.
He said he did not want a repeat of what he had to undergo during a verdict last October. At that time, the courtroom erupted when Keeler, who presided over the non-jury trial, found co-defendant Joseph James Holmes, 30, of Chester, not guilty of conspiring with Day in Beverly?s killing.
The testimony at both trials was markedly different. And there was no testimony linking Holmes to the violent Boyle Street Boys drug gang as occurred during Day?s trial.
Several members, including Brian Rogers, 25, who pleaded guilty in federal court in one killing and conspiracy in another, testified that Day admitted he killed Beverly. "He shot him in the face a couple of times," Rogers quoted Day as saying.
Another crucial witness came from Day?s cousin, who is not a gang member. The cousin while on the stand wiped away tears and reluctantly tied Day to Beverly?s shooting death.
"I asked him if he done it. He (Day) told me he killed the cop -- he shot him. He said he done it. I?m not sure of his words," he testified.

The indictment charged these defendants with operating a racketeering enterprise in South Norwalk, Connecticut from 1997 to June 2001, which enterprise was responsible for numerous shootings and other acts of violence in South Norwalk and Bridgeport. Evidence at trial proved that BUCHANAN served as an enforcer for the Burden Organization and that he assisted in the packaging and distribution of more than 1.5 kilograms of crack cocaine.
In June 1999, BUCHANAN attempted to kill Rodrick Richardson, a member of the Hill Crew and a long time rival. BUCHANAN, acting at Kelvin Burden's direction, opened fire from point blank range on Richardson outside of Les New Moon Café on Bouton Street in Norwalk. Richardson was struck in the arm by one of the bullets.
Evidence at trial also proved that BUCHANAN murdered Derek Owens and shot Marquis Young, an individual who had a long-standing feud with the Burden Organization. Kelvin Burden held Young responsible for the shooting death of Burden's brother Sean Burden, who was shot to death on May 13, 1998 in Norwalk. Young was a passenger in the car at the time, but was not involved in the shooting. Michael Burgess of the Bronx was convicted last week of shooting Jason Russell, 18, once in the head on Sept. 9, 2002. He also was found guilty on a weapons charge.
A co-defendant, Lamar Conner, 22, of Co-op City, last month pleaded guilty to manslaughter for his role in the fatal shooting. Under terms of the plea agreement, he will be sentenced to 131/2 years in prison.
Bronx Supreme Court Justice Richard Price set sentencing for both Conner and Burgess, of 3400 Paul Ave., for March 10.
Burgess faces a maximum sentence of 25 years to life on the murder charge and up to 15 years on the weapons charge.
Russell was gunned down on the steps in front of 2427 Webster Ave. as he was entering the building.
Authorities said both Burgess and Conner opened fire from the window of a second-floor apartment, leaving a single 9-mm. bullet lodged in the dead man's brain.
Although all three men were members of the Bloods gang, Russell belonged to a Manhattan-based faction and had encroached on the defendants' crack cocaine sales turf, the prosecution contended.
The jury heard testimony that Russell was murdered in order to eliminate the competition for profits from illegal drug sales.

(July 14, 2004) — It's time to reclaim the streets of Rochester from violent hoodlums, the anguished mother of a murder victim said Tuesday.
Speaking before gang member Lucius Wright III was to be sentenced for gunning down Robert Barney II last year on his 29th birthday, Linda Barney asked that Wright be kept behind bars as long as possible.
“I'm asking you, begging you, please don't give him a chance to hurt another family,” she told state Supreme Court Justice Francis A. Affronti. “Let him and his gang members know that if you do a crime, you're going to pay for it.”
Moments later, Affronti ordered the 19-year-old Wright to prison for 65 years to life for killing Barney, robbing and kidnapping another man and attempting to rob a third on Aug. 31, 2003.
Wright, who is charged with an unrelated murder and is being investigated for involvement in a third, will be eligible for parole in 2068, when he's 83.
Prosecutors said Wright was a member of northeast Rochester's Dipset gang, which police targeted last year after linking its members to at least 10 homicides.
Through two multi-agency initiatives — Operation Impact and Operation Ceasefire — law enforcement agencies arrested a dozen gang members last fall for a variety of violent crimes, dismantling the organization.
“This is the culmination of a lot of hard work by a lot of people,” Monroe County District Attorney Michael C. Green said after Wright was sentenced.
Wright was convicted in June of second-degree murder, first-degree robbery, attempted first-degree robbery and second-degree kidnapping. He maintains his innocence and intends to appeal, said his lawyer, Culver K. Barr.
The string of crimes began when a 16-year-old was walking away from watching a dice game on East Main Street. A car pulled up and a man got out, robbed the youth at gunpoint and abducted him, Assistant District Attorney David A. Foster said.
Several men in the car drove around with the teenager until the dice game broke up. Barney and his brother, who had been at the game, were walking down Leighton Avenue when the car pulled up and a gunman shot Barney in the back and attempted to rob his brother.
Wright insists he was the driver, not the gunman.

Lucius Wright III also is charged with second-degree murder in the death of Antwan Spivey, 21, who was shot outside a Chili party house on Sept. 13. Prosecutors say he also has admitted involvement in the slaying of Ocie T. Freeman, 47, who was found shot to death in northeast Rochester Sept. 6.
Wright already is serving a two-year prison term for second-degree assault for slightly wounding another man by shooting him in the face with a shotgun on June 8, 2003.

“I'm asking you, begging you, please don't give him a chance to hurt another family,” she told state Supreme Court Justice Francis A. Affronti. “Let him and his gang members know that if you do a crime, you're going to pay for it.”
Moments later, Affronti ordered the 19-year-old Wright to prison for 65 years to life for killing Barney, robbing and kidnapping another man and attempting to rob a third on Aug. 31, 2003.
Wright, who is charged with an unrelated murder and is being investigated for involvement in a third, will be eligible for parole in 2068, when he's 83.
Prosecutors said Wright was a member of northeast Rochester's Dipset gang, which police targeted last year after linking its members to at least 10 homicides.
Through two multi-agency initiatives — Operation Impact and Operation Ceasefire — law enforcement agencies arrested a dozen gang members last fall for a variety of violent crimes, dismantling the organization.
“This is the culmination of a lot of hard work by a lot of people,” Monroe County District Attorney Michael C. Green said after Wright was sentenced.
Wright was convicted in June of second-degree murder, first-degree robbery, attempted first-degree robbery and second-degree kidnapping. He maintains his innocence and intends to appeal, said his lawyer, Culver K. Barr.
The string of crimes began when a 16-year-old was walking away from watching a dice game on East Main Street. A car pulled up and a man got out, robbed the youth at gunpoint and abducted him, Assistant District Attorney David A. Foster said.
Several men in the car drove around with the teenager until the dice game broke up. Barney and his brother, who had been at the game, were walking down Leighton Avenue when the car pulled up and a gunman shot Barney in the back and attempted to rob his brother.
Wright insists he was the driver, not the gunman.

The verdict, coming Monday after about six hours of deliberations stretching from late last week, capped a three-week trial in U.S. District Court.
Walter ‘‘Heavy’’ Williams, 31, the leader of the Imperial Insane Vice Lords, faces life in prison. Two other gang members, Allen ‘‘Capone’’ Young, 34, and Michael ‘‘New York’’ Smith, 21, also were convicted. Young could receive life in prison while Smith faces up to 40 years.
Seventeen gang members had pleaded guilty, leaving the case against Williams, Young and Smith as a test of a federal task force’s use of conspiracy laws to dismantle an entire gang.
‘‘It’s tough to infiltrate a gang,’’ Assistant U.S. Attorney David Jennings told The Knoxville News Sentinel. ‘‘We used every tool available to investigate this case. Federal drug conspiracy laws are tough. We went into this investigation thinking that proving a drug conspiracy was the only effective way to take the Vice Lords off the streets for a very long period of time.’’
Attorneys for the convicted gang members said they would appeal.
The case began in July 2002 with an indictment that named 20 gang members as co-conspirators and said the gang’s only purpose was to run the crack market in Knoxville’s inner city. A task force that included the FBI, the U.S. Drug Enforcement Administration and the Knoxville Police Department spent more than a year compiling evidence in the case.

A Shelby County jury late Thursday convicted a known gang member for the shooting of a woman who he was previously charged with kidnapping.
The jury found Torian Dillard, 30, guilty as charged for attempted first degree murder, reckless endangerment, and being a convicted felon in possession of a handgun for the February 11, 2003 incident.
Dillard, who is an admitted member of the California Crips gang, fired shots at the victim, who he allegedly kidnapped months before, while she sat inside her car on Kimball Avenue. Dillard shot the victim in the back of the head at nearly point blank range while she was picking up her children from Cherokee Elementary School. As she stepped on the gas to get away, her car struck another vehicle at the intersection of Kimball and Semmes Street. Dillard had been threatening the victim since he made bond in November 2002 on the kidnapping charge. Dillard still faces trial on that charge. He also faces trial on harassment charges.
Dillard escaped last January from the Memphis Mental Health Institution where he was being evaluated. Memphis police captured Dillard the same evening. He pleaded guilty to escaping from incarceration last February.
Dillard is scheduled to be sentenced by Judge James Beasley on October 8, 2004. He faces 25 to 40 years on the attempted murder charge, six years on the reckless endangerment charge and 6 years on the handgun charge. Assistant District Attorneys Jerry Harris and Paul Hagerman prosecuted this case. Harris is the D.A.’s chief homicide prosecutor and Hagerman is part of the D.A.’s Gang Prosecution Unit.

Flores then turned and expressed his love to his friends and relatives, including his sobbing mother and sister.
"Be strong and I will see you all, hopefully not soon. Keep your head up," he said.
After taking a couple of deep breaths and gasping, he slipped into unconsciousness. Nine minutes later at 6:20 p.m., he was pronounced dead.
Flores, 32, became the 13th Texas prison inmate to receive lethal injection this year. At least 11 others have execution dates for later in 2004, including five next month.
The U.S. Supreme Court in April refused to review his case and the inmate's lawyer said there were no legal avenues left to pursue. On Friday, the Texas Board of Pardons and Paroles rejected a commutation request.
Flores pleaded guilty to gunning down John Moreno, 23, whose July 1993 murder was captured on videotape by a surveillance camera at the San Antonio store where he worked.
Flores and a companion were recognized after the tape was aired on San Antonio television stations. They were arrested within hours of the shooting. At the time, Flores was on probation for car theft and had other arrests for theft and weapons violations.
He confessed to the crime and gave to authorities cash taken in the robbery and the .22-caliber handgun used in the slaying.
During the punishment phase of the trial, witnesses were told how Flores, who picked up the street name "Showtime," led a San Antonio gang where he recruited fourth-graders to fight and steal for him. Among the witnesses was a 14-year-old girl who told of how Flores and other gang members had tried to rape her.
Jurors also were shown the video, which shows Moreno emptying the cash register but balking at surrendering his keys. Moreno gets on his knees begging for his life and Flores shoots him in the head and runs from the store. Then he returned moments later to go through the victim's pockets in search of car keys.
"It's fair to say the jury really had no choice but to reach this verdict," Mike Cohen, the Bexar County assistant district attorney who prosecuted Flores, said. "It was pretty brutal and senseless."
Flores' partner, Joseph Fritz, was convicted of capital murder for being the lookout during the robbery and received a life prison term. Testimony at his trial indicated they couldn't drive off in Moreno's car because Flores took the wrong keys from the dying man's pocket.
Cohen speculated Moreno was reluctant to surrender his keys because he and his wife had only that one car and it was needed to take their then 10-month-old daughter for frequent medical treatment.
The Texas Coalition to Abolish the Death Penalty, in a statement protesting today's punishment, argued Flores had a history of mental illness and that lawyers failed to inform jurors of his mental problems brought on by alcohol abuse and physical and sexual abuse suffered as a child.
While the Supreme Court has barred execution of the mentally retarded, the same prohibition has not been extended to those considered mentally ill. The abuse allegations and questions about the competence of his trial attorneys were raised in earlier unsuccessful appeals.

Last January, Tyree Leland Jackson agreed to a 26½-YEAR PRISON SENTENCE when he pleaded guilty to taking part in a shooting that killed a Roseville college student as he was trying to flee the scene of a clash between rival street gangs.
Jackson, 21, described as a member of the Bloods, agreed to testify against Martise Anthony Bowie, 16, who also was charged in the shooting and was certified to stand trial as an adult.
But then Jackson withdrew his guilty plea.
Late Thursday, after a one-week trial and three hours of deliberation, a jury in Minneapolis convicted Jackson of first-degree premeditated murder. He faces a mandatory sentence of life in prison and must serve at least 30 years before he's eligible for parole.
The shooting outside a south Minneapolis residence on May 16, 2003, killed Thomas Francis Olson, 19, who had just completed his first year at Northwestern College in Roseville. Police investigators said Olson was attending a party at 4725 Elliot Ave. S., when a fight erupted.
According to police reports, Olson was attacked by Bowie and Jackson and was fleeing in his car when the two opened fire. He died from a gunshot wound in the head.
"This is another example of a senseless death caused by gang violence," said Hennepin County Attorney Amy Klobuchar. "The victim was an innocent college student who didn't want to fight and was just trying to get away from these gang members."
Bowie, who was 15 when the slaying occurred, is awaiting trial, though no date has been set.
He also is charged in a separate shooting that took place two weeks before Olson's death. In that incident, Bowie is accused of firing from a car at a boy who riding a bicycle in south Minneapolis.
The victim was hit in the buttocks. Bowie was charged with first-degree assault in a complaint that identified him as a member of the Bloods street gang.
Jackson's sentencing date was set for Oct. 12.
