8 Face Murder Charges in ‘03 Prison Riot

Capping a four-month law enforcement probe into a deadly riot at a privately run prison, eight inmates were charged with murder Wednesday in connection with the October melee that left two convicts dead at the Eagle Mountain state prison south of Palm Springs.

Six additional inmates were charged with assault with a deadly weapon, following a Riverside County district attorney and Sheriff’s Department inquiry into the 90-minute fight among 150 inmates armed with barbecue skewers, meat cleavers, two-by-fours and broom handles.

“The evidence will show [the defendants’] behavior was animalistic, primitive and racially motivated,” said Riverside County Deputy Dist. Atty. Ulli McNulty, who is handling the case. “The crime scene they left behind was death and devastation.”

A Riverside County Superior Court judge in Indio agreed to postpone the arraignments of all but one of the 14 defendants until March 17. The other defendant had been jailed in Los Angeles County on an unrelated charge and will probably also have a March 17 arraignment.

Three of the 14 inmates each face two murder charges for the deaths of Master Leroy Hampton, 34, who was serving a 16-month term for a drug offense, and Rodman Fitzgerald Wallace, 39, who was serving two years for burglary, both of Los Angeles County.

Those charged with two murder counts are David Olivares, 31, Peter Cardenas Morales, 23, and Jason Samuel Hernandez, 29. Facing one count of murder are Hector Ramirez Careyo, 32; Anthony Ramirez Rimoldi, 38; Eric Stephen Lewis, 33; Jose Luis Rodriguez, 35; and Byron Walter Mayfield, 35.

The inmates charged with murder also will be charged with special allegations that the crimes were race-related, subjecting them to the death penalty or a life-without-parole sentence if convicted, authorities said. Seven of those charged with murder were arrested while in custody at Ironwood State Prison in Blythe, authorities said. A few others, however, had been released from custody and were under supervision. Olivares was in custody in Los Angeles County.

Riverside County Sheriff’s Department homicide investigator Ben Ramirez said the case is still under investigation and that “there’s still a possibility of additional suspects being filed on.” However, McNulty said he did not expect other inmates to be charged with murder.

The trouble began at 7 p.m. on Oct. 25 after a fight between a Latino and an African American in a recreation room while inmates were watching the World Series, according to court documents. It soon erupted into an all-out brawl that spilled outside into the prison’s weightlifting area.

Dozens of officers from the two state prisons in Blythe were called in to help end the situation that had escalated as Latino, white and African American inmates began pitching rocks at one another and arming themselves with whatever they could get their hands on: meat cleavers, forks and knives seized from a kitchen, fire extinguishers, broom handles, two-by-fours, crutches and chair legs.

Numerous African American inmates suffered cuts and bruises when they tried to escape the fray by scaling a 12-foot fence.

Hampton and Wallace, however, didn’t make it over the fence and were swarmed by Latino and white inmates swinging weapons.

Hampton and Wallace were each stabbed more than a dozen times in the head and upper torso, authorities said.

The Riverside County district attorney’s complaint against the inmates alleges that Morales used a shank and barbecue fork to attack Wallace and a pole and pipe to injure Hampton; that Hernandez attacked Wallace and Hampton with a shank and knife; and that Olivares used a shank on Wallace and a pole and pipe against Hampton. Defendants Lewis and Mayfield apparently used a crutch in their combined attack on Hampton, authorities said, Rimoldi allegedly hacked Hampton with a meat cleaver, and Rodriguez is said to have stabbed Hampton with a knife.

The riot was quelled when a corrections officer fired a warning shot into the ground near a room where African American inmates had gathered. After security was restored, officers determined that Hampton and Wallace had died and that six African American inmates and one Asian inmate had been severely injured.

The deaths were the first violence-related fatalities at any of the nine California prisons run by private corporations under contract with the state at that time.

The violence caused about $15,000 in property damage – broken windows, torn fencing, smashed furniture – at the prison, which was among three private corrections facilities closed two months later as part of a state cost-cutting move.

The sheriff’s investigation involved more than 500 interviews, dozens of lineups, and high-tech forensic techniques including the matching of digitally enhanced surveillance video footage with photographs taken of the faces of every inmate in the prison, as well as identifying marks, such as old injuries and tattoos.

When told by authorities that he had been videotaped participating in the attacks, Rimoldi replied, “If you seen me, then you seen me,” according to the sheriff’s investigation.

McNulty said, however, that though it remains unclear if all eight inmates charged with murder inflicted fatal wounds, “the conclusion you can draw is that they all participated in this massive beating.”

The Eagle Mountain riot was followed less than two months later by a riot involving 50 inmates at a privately run prison in Baker. Twenty five of them face disciplinary charges by the state Department of Corrections, an official said.

ive never heard of a black being shot by a prison guard...a sureno in plesent valley (blanco de 18) was killed by guards in the kitchen...a sureno in the bay was shot by guards and killed...a bulldog and norteno were both shot and killed in susenville...since blacks are so out numbered in the pen...alot of the blacks who aren't gangsters (and the weaker gang members)...will run toward the police for safety during a race riot...which is why a warnig shot was fired near a room of africans...to prevent them from being attacked...even hen you watch the "infamous" video of the largest riot in cdc history up at the bay...you see surenos attcking...and you see blacks running...dont get me wrong alot of times the blacks get their money...but usually their on the defensive...not being aggresive... it may take 5 surenos to take down a large black man...and one or two of them may get a lil banged up...but the mentality is different...a sureno would rather be beat to a bloody pulp attempting to jump on a bigger man...because if they ran like lots of the other races do...they will be stabbed by other surenos...other races dont do this...which is why surenos are much more agressive as a whole...and are shot by the police more often...high

Thats a damn good post... but I am unfamiliar with sureno being shot by police more than Blacks. Of course if the South v. North or South v. White jumps off there's a high chance of a Latino being shot/killed... thus, my statement was regarding the fact that when Blacks are involved in any dispute I personally have only witnessed the Blacks being fired on and hit. Am I saying that only Blacks are shot, no. But I am saying it will never surprise me to see or hear Blacks being fatally or seriously injured during a fight with another race.

Before long, a guard shot and killed three blacks. According to the guard's testimony before a Monterey County grand jury, the blacks were beating a white inmate. But at Corcoran's Security Housing Unit (SHU), reserved for 1,800 problem inmates sent from other prisons, it was allegedly perverted into a system of staged brawls. Dimas de Leon, an SHU inmate from 1988 to 1990, claimed to have been involved in 11 staged fights in which his boxing skills made him a favourite.

"I was made aware by officers that there was money riding on me to win," he said in an affidavit. "I was even thanked by officers for making them a bit richer." But it was the killing of Preston Tate, a 25-year-old gang member from South Central Los Angeles, that persuaded several officers to become whistle-blowers. He died in April 1994 after officers opened fire in a section of the SHU known as the "shooting gallery".

A videotape, which is now the basis of a law suit filed by his family, showed Tate, who was black, being charged by two Latino gang members and eventually being shot in the head as guards opened fire to break up the fight. An official report cleared the officers of wrongdoing. But Steve Rigg, a Corcoran lieutenant for six years and one of those co-operating with the FBI in a civil-rights investigation into the incident, became convinced the fight was rigged. Tate had recently been moved into a cell adjacent to his assailants, and in another tell-tale sign, a number of supervisors had gathered in the control booth. It was the second watch in the same building that is suspected of staging a series of "cockfights".

In eight months in 1994, 85 fights broke out in the period from 6am to 2pm, by contrast with just eight fights in the third watch, overseen by Mr Rigg. "They wanted to create fights," he said. "I think they liked shooting at some of the troublemakers. They wanted to get their little ounce of revenge."

One was involved in a small melee, and three others were engaged in stand-up fistfights in which no warning shots were fired, no weapons were found and no inmates had inflicted any serious injuries. The bullets that killed them were designed not to exit the body but to explode on impact.

Vincent Eugene Durham, a 23-year-old Black man from Los Angeles, had been imprisoned for grand theft and was six months shy of his April 1992 release date when he was gunned down in a fistfight.

In September 1993, a 29-year-old drug violator named Robert Moore became embroiled in a fistfight with his cellmate, according to the state’s account. The two men initially heeded an officer’s warning to stop fighting; then Moore resumed his attack. The gunner fired a warning shot followed by a fatal shot that struck Moore in the neck, fragments of bone and bullet slicing through the main artery in his heart.

The state shooting review board cleared the gunner and determined that he killed Moore by mistake, intending only to disable him. Moore’s mother sued, arguing that the 9-millimeter bullet was deadly by design. The officer had fired even though Moore wasn’t wielding a weapon or inflicting great bodily harm. She won an out-of-court settlement for $300,000.

In late 1994, with the deaths and lawsuits mounting, the state’s shooting practices came under harsh attack in a series of articles in the Orange County Register. The FBI had already launched a probe into one fatal shooting at Corcoran. This was followed by a far-reaching federal court opinion in 1995 that found that state prison policies “promoted the use of lethalforce” in 20 fatal and serious shootings at Pelican Bay State Prison.

New Folsom Riot

No one disputes that what took place at New Folsom prison on Sept. 27, 1996, was a riot between Latino and black inmates armed with knives and other homemade weapons. Scores of fighters in the main exercise yard refused to heed verbal and gunshot warnings. When it was over, one Latino inmate lay dead and four black inmates were wounded.

The disturbance lasted 30 minutes and was one of the largest disturbances in CDC history. Correctional officers used batons, pepper spray, .37 mm launchers, and mini-14 rifles.

well there aint no arguing with them facts...you brought alot of information to light...i was in CDC from 96-01...i dont just post to pump up one side of the fence...ive been through alot of these situations personally...i had never heard of anybody but mexicans being shot behind the walls...and i had conversations with alot of older black men while incarcerated...the dude i remember the most was a lifer from sac...not a gang member...he entered prison in 76 (when i was born)...he told me how the whites were dominate back then...lots of "dirty bikers" like he called them...the whites he said had al the good prison jobs...alot of weapons...alot of drugs...and alot of raciest prison guards on their side...times change...good looking out ...high

I watched this show on this incident -I guess Tate was a buffed out /felon , he had been communicating with his dad and explained to him that he was scared to go out to the yard because Surenos were on the offensive attacking blacks --He told his father that -although he didnt want to get involved he had no choice because had he refused his yard call he would be labeled a coward who refused to fight.It may seem cowardish to you that he was attacked by 2 surenos but this TATE was massive , 6' 4 225 lbs, the video shows the surenos rushing him as soon as he hit the yard .One of the surenos was shot in the leg and you can see him stumble and drop -the bullet that killed TATE , bounced off the walls and smashed into him.I aint trying to pump up Surenos --but the truth is dude -alot of us guys who have been to the joint have been locked up with the same black guys since we were juveniles. Their aint alot of fear for men who have been fighting since kids -that fear kinda goes away -and you become more of a savage and just really dont give a fux--rushing a dude thats 6'4 and outweighs you by double is almost seen as sport to YA surenos ---kinda LIKE FIGHTING A BEAR WITH YOUR BARE HANDS.
